Drama erupted in Thika after a family confronted auctioneers over the seizure and auction of two lorries valued at about Sh7 million.

Speaking to journalists in Thika town, the owner, Rufus Kiretai, said the dispute traces back to a 2018 incident in which his driver was charged with dangerous driving causing death.

The driver was later acquitted, after which Kiretai opted to settle the matter out of court with the deceased’s family.

The lorries were allegedly repossessed and auctioned without due process, Kiretai claimed, leaving him in severe financial and emotional distress.

“We agreed with my family and took a loan using our land as collateral and money paid to the lawyer upon agreement that I would continue to pay the remaining balance in bits,” Kiretai said.

Kiretai, accompanied by his family, including four school-going children, caused a scene at the office, saying the loss of the vehicles deprived him of his only source of income.

“At this point, my family is suffering. Friends have supported me for so long that they are even tied. My children are now forced out of school due to unpaid fees. We have been served notice to vacate our residence over rent arrears,” he added.

Kiretai maintains there was no lawful justification for how the vehicles were repossessed and sold.

Under the original settlement, Kiretai was required to pay Sh2.5 million, with 30 per cent allocated to legal fees.

He says he paid Sh1 million in cash to the deceased’s family and about Sh765,000 to their lawyer, while the remaining balance was to be paid in monthly instalments of Sh45,000.

He further alleged that during the repayment period, an auctioneer repossessed his vehicles and demanded over Sh500,000 in repossession, storage, and related charges.

Before he could raise the money, the two lorries were auctioned.

The auctioneer, Eliud Wambu, confirmed the vehicles were sold, noting the matter is now before the court, something that Kiretai also disputed.
